Terms & Conditions

Please read these terms carefully before accessing the website, booking a class or participating in any Abhinav Gupta Yoga service.

01 Acceptance of Terms

By accessing the website at abhinavguptayoga.com or abhinavguptayoga.practicenow.us, you agree to be bound by these Terms and Conditions, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

02 Use of the Platform

The PracticeNow platform enables you to engage in online and offline classes facilitated by your chosen teacher or institution ("Teacher"). You must comply with all rules and guidelines set by the Teacher and PracticeNow.

03 Student Responsibilities

You are responsible for ensuring that you have the necessary equipment and internet connection to participate in online classes. You must adhere to all guidelines and codes of conduct set by your Teacher, including attendance, behaviour and submission of assignments.

04 Payments

If applicable, payments for classes, courses or other services must be made through the PracticeNow platform or as directed by your Teacher. All payments are subject to the terms and conditions set by the Teacher and PracticeNow.

05 Abhinav Gupta Yoga Rights

The following are Abhinav Gupta Yoga’s rights in regard to the Services and these Terms of Service:

  • We reserve the right to modify or terminate the Services for any reason, without notice at any time. We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Services.
  • We reserve the right to change the prices for our Services without notice at any point in time.
  • We reserve the right to refuse our Services to anyone for any reason at any time.
  • We may, but have no obligation to, remove Activity or suspend an Account Owner’s access to the Services if they share or otherwise make available Activity containing material that we determine in our sole discretion is unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene, otherwise objectionable, or violates any party’s intellectual property or these Terms of Service.
  • Verbal or written abuse of any kind, including threats of abuse or retribution, by an Account Owner or its representatives directed at any Abhinav Gupta Yoga customer, employee, member or officer will result in immediate account termination.
  • We are not responsible if information made available on the Abhinav Gupta Yoga website is inaccurate, incomplete or obsolete. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting primary, more accurate, complete or timely sources. Any reliance on the material on this site is at your own risk.
  • The Abhinav Gupta Yoga website may contain certain historical information. Historical information is not current and is provided for reference only. We reserve the right to modify the contents of this site at any time, but have no obligation to update any information. You agree that it is your responsibility to monitor changes to our site.
  • If we reasonably believe that any of your content breaches these terms or our policies, violates applicable law, or could harm our users or third parties, we reserve the right to remove some or all of that content in accordance with applicable law. Examples include child pornography, content that facilitates human trafficking or harassment, and content that infringes another person’s intellectual property rights.

06 Health/Medical Disclaimers

6.1 In the interest of your physical and mental wellbeing, you understand and acknowledge that:

6.1.1 Disclaimer by Abhinav Gupta Yoga

  1. The Company makes no claims, representations or guarantees that the Platform Services offered would provide a therapeutic benefit to all Users. We disclaim any guarantees of exactness as to the duration, type or satisfaction from the Yoga Services provided by us.
  2. The Company is not a healthcare provider or medical device provider. Our Yoga Services are neither medical or healthcare advice, nor a replacement for or form of therapy, and are not intended to cure, treat or diagnose any medical condition a User may have.

6.1.2 Inherent risks

The Services offered, by their nature, include certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries or losses. You assert that your participation is voluntary and that you knowingly assume all such risks, and therefore release Abhinav Gupta Yoga, its instructors, staff and owners from all liability arising from such risks.

6.1.3 Illness/Injury

You are aware of your physical limitations and medical history and that participation in our Yoga Services may, in some circumstances, result in physical injury or impact or worsen a psychological condition or mental fitness. You undertake that you are sufficiently self-aware and will stop any physical activity before becoming ill or injured, physically or psychologically. You will not attribute any such illness, injury or loss to the Platform Services offered by us.

6.1.4 Medication and substances

You will not participate in the Platform Services or undertake exercises or training offered through our platform while under the influence of heavy medication, drugs, alcohol or other mood-altering substances.

6.1.5 Consultation with a physician or healthcare provider

  1. You will consult your physician or healthcare provider before enrolling in Yoga Services or booking classes, especially if you are or suspect you may be pregnant, wear a pacemaker, suffer from epilepsy or seizures, have a history of mental illness or an eating disorder, have diabetes or another physical, psychological, emotional or medical condition, or are taking strong medication.
  2. You will obtain the approval of your healthcare provider or doctor before participating in the Platform Services, especially if you are over 65 years of age.

6.1.6 Medical Aid

There is no obligation for any person to provide you with medical care while performing activities offered under the Platform Services. You understand that there may be no aid stations available for the activity and that, if medical care is rendered while you are unable to consent, you consent to that care.

6.2 Release

You, for yourself and for your heirs, next of kin, executors, administrators and assigns, fully release, waive and forever discharge any and all rights or claims of any nature whatsoever, including claims pertaining to physical or mental injury or illness, or claims arising from negligence by Abhinav Gupta Yoga, its instructors, staff, owners or anyone else, that you may have now or in the future against the Company, its affiliates, franchisees and their respective representatives, directors, officers, independent contractors, consultants, agents, employees or volunteer staff in relation to or arising from your use of Platform Services. Without limiting the foregoing, you further release any recourse you may now or hereafter have resulting from any decision of any Released Party.

07 Refund Policy

Fees once paid will not be refundable.

08 Validity of Plans

Your plan will expire when you finish the number of classes included in the plan or when the plan’s validity date passes, whichever occurs first.

If you miss any session for any reason, it will not be carried forward beyond the plan validity date or into the next month.

09 Privacy

Your privacy is important to us. Please review our Privacy Policy for information on how your personal information is collected, used and shared.

10 Intellectual Property

All content, including but not limited to class materials, videos and documents provided by the Teacher, is the intellectual property of the Teacher or other rightful owners. You may not distribute, reproduce or use this content in any way without express permission.

11 Disclaimers and Limitations of Liability

PracticeNow and the Teacher make no warranties, expressed or implied, and disclaim and negate all other warranties. Neither PracticeNow nor the Teacher shall be liable for any damages arising from your use of the platform.

12 Agreement of Release and Waiver of Liability

By registering and participating in any class, you agree to the terms outlined in the Abhinav Gupta Yoga Agreement of Release and Waiver of Liability. You agree to the following:

  • You are participating in a Yoga Class, Workshop or pre-registered yoga session offered by Abhinav Gupta Yoga, during which you will receive information or instruction about yoga. You recognise that yoga may require physical exertion, which may be strenuous and may cause physical injury. You are fully aware of the risks and hazards involved.
  • You understand that it is your responsibility to consult a physician before and regarding your participation in a Yoga Class, Workshop or pre-registered yoga session. You certify that you are physically fit and have no medical condition that would prevent your full participation.
  • You agree to assume full responsibility for any risks, injuries or damages, known or unknown, that may arise from participating in any yoga programme at Abhinav Gupta Yoga, including online live-streaming yoga.
  • You knowingly, voluntarily and expressly waive any claim that you may have against Abhinav Gupta Yoga, its instructors, staff and owners for any injury or damages sustained as a result of participating in a Yoga Class, Workshop or pre-registered yoga session.
  • You agree that you will not record, photograph or video any online classes and will fully respect other students’ privacy. Violation of this clause will result in termination from all future classes, and we reserve the right to pursue all legal recourse. Abhinav Gupta Yoga does not take responsibility for any violation of this provision by a third party.
  • You, your heirs or legal representatives forever release, waive, discharge and covenant negligence or other acts.
  • You have read the above release and waiver of liability and fully understand its contents.
  • By purchasing a Membership, booking an online class, workshop or any other event, you state that you fully and voluntarily agree to these Terms and Conditions and acknowledge that you have read and fully comprehend the nature and consequences of this agreement.

13 Modifications to Terms

PracticeNow or Abhinav Gupta Yoga may revise these Terms and Conditions at any time without notice. By using this website, you agree to be bound by the then-current version of these Terms and Conditions.

14 Governing Law

These Terms and Conditions are governed by the laws of the jurisdiction in which your Teacher operates, and any disputes will be resolved in accordance with those laws.
